Data Processing Agreement for Curateit.Club

Effective Date: 27 December 2024

This Data Processing Agreement (“DPA”) is between CurateIt.Club (“Processor”) and user of our service (“Controller”) to ensure compliance with GDPR and other applicable data protection laws.

1. Scope and Purpose

The Processor agrees to process personal data only as necessary to provide services to the Controller.

2. Processor Obligations

  • Process data only on documented instructions from the Controller.
  • Ensure confidentiality and security of personal data.
  • Implement appropriate technical and organizational measures to protect data.

3. Sub-Processors

The Processor may engage sub-processors with prior written consent from the Controller and ensure they comply with equivalent data protection obligations.

4. Data Breach Notification

The Processor will notify the Controller without undue delay upon becoming aware of a personal data breach.

5. Data Subject Rights

The Processor will assist the Controller in responding to data subject requests under GDPR.

6. Data Deletion

Upon termination of services, the Processor will delete or return all personal data to the Controller unless required by law to retain it.

7. Indemnification

The Controller agrees to indemnify, defend, and hold harmless the Processor, its officers, directors, employees, representatives, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to the Controller’s instructions for processing personal data, violation of applicable data protection laws, or infringement of third-party rights.

The Controller may audit the Processor’s compliance with this DPA upon reasonable notice.

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and CurateIt.Club (“We,” “Us,” or “Our”) that governs your use of our website and associated services (collectively, the “Service”).
